Welcome to My Beautiful Ghana (“we,” “us,” “our,” or “the Platform”). By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our Platform.
My Beautiful Ghana is a comprehensive tourism and business platform offering accommodation booking, accommodation listings, tour services, event listings, banner advertising, e-commerce, real estate listings, and news/entertainment content.
2. Definitions
- User: Any person who accesses or uses the Platform
- Partner: Accommodation providers, tour operators, event organizers, or other service providers who list their services on the Platform
- Guest/Customer: Users who book or purchase services through the Platform
- Listing: Any accommodation, tour, event, product, real estate, or service advertised on the Platform
- Services: All features and functionalities offered by My Beautiful Ghana
3. Eligibility
You must be at least 18 years old to use our Services. By using the Platform, you represent and warrant that you have the legal capacity to enter into binding contracts under Ghanaian law.
4. Account Registration
4.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
4.2 Account Types
- Guest Accounts: For booking accommodations, tours, and purchasing products
- Partner Accounts: For listing accommodations, tours, events, real estate, or selling products
- Business Accounts: For banner advertising and business services
5. Booking and Transaction Terms
5.1 Accommodation Bookings
- All bookings are subject to availability and confirmation by the accommodation partner
- Prices displayed are in Ghana Cedis (GHS) unless otherwise stated
- Booking confirmation will be sent via email upon successful payment
- Check-in/check-out times and house rules are determined by individual accommodation partners
5.2 Tour Bookings
- Tour availability, itineraries, and inclusions are as described in the listing
- Minimum participant requirements may apply to certain tours
- Weather-dependent tours may be rescheduled or cancelled with appropriate notice
- Participants must meet age, health, and fitness requirements specified for each tour
5.3 Payment Processing
- All payments are processed securely through Paystack, our authorized payment processor
- We accept credit/debit cards, mobile money, and other payment methods supported by Paystack
- By providing payment information, you authorize us to charge your payment method for the total amount
- Payment is due at the time of booking unless otherwise specified
5.4 Service Fees
- My Beautiful Ghana charges a service fee on bookings and transactions
- Service fees are clearly displayed before payment confirmation
- Listing fees for Partners are non-refundable once listings are published
6. Cancellation and Refund Policy
6.1 Guest Cancellations
Accommodation Bookings:
- Cancellation more than 14 days before check-in: Full refund minus 10% processing fee
- Cancellation 7-14 days before check-in: 50% refund
- Cancellation less than 7 days before check-in: No refund
- No-shows: No refund
Tour Bookings:
- Cancellation more than 7 days before tour date: Full refund minus 15% processing fee
- Cancellation 3-7 days before tour date: 50% refund
- Cancellation less than 3 days before tour date: No refund
- Weather-related cancellations by operator: Full refund or reschedule
E-Shop Purchases:
- Physical products: Return within 7 days of receipt if unused and in original packaging
- Digital products: No refunds after download/access
- Personalized/custom items: No refunds unless defective
6.2 Partner Cancellations
- If a Partner cancels a confirmed booking, the Guest receives a full refund
- Partners may face penalties or account suspension for repeated cancellations
- Force majeure events may be considered on a case-by-case basis
6.3 Refund Processing
- Approved refunds are processed within 5-10 business days
- Refunds are issued to the original payment method
- Transaction fees and service charges are generally non-refundable
7. Partner Listing Terms
7.1 Listing Requirements
- All listings must be accurate, complete, and not misleading
- Photos must genuinely represent the accommodation, tour, product, or service
- Pricing must be clearly stated with all applicable fees disclosed
- Partners must have legal authority to offer the listed services
7.2 Listing Fees
- Accommodation listings: Monthly or annual subscription fees apply
- Featured listings: Additional promotion fees apply
- Event listings: Per-event posting fees
- Real estate listings: Tiered pricing based on property value and listing duration
- E-shop listings: Commission on sales or monthly subscription
7.3 Quality Standards
- Partners must maintain the quality and accuracy of their listings
- Services must be provided as described in the listing
- Partners must respond to booking inquiries within 24 hours
- Failure to meet quality standards may result in listing removal
8. User Conduct and Prohibited Activities
You agree NOT to:
- Violate any applicable laws or regulations
- Provide false, inaccurate, or misleading information
- Impersonate any person or entity
- Engage in fraudulent activities or money laundering
- Upload viruses, malware, or harmful code
- Harass, abuse, or harm other users or Partners
- Scrape, copy, or steal content from the Platform
- Use the Platform for any illegal purpose
- Circumvent our booking and payment systems
- Post discriminatory, offensive, or inappropriate content
- Manipulate reviews or ratings
- List counterfeit, stolen, or illegal items
9. Intellectual Property Rights
9.1 Platform Content
- All content on My Beautiful Ghana, including logos, text, graphics, and software, is owned by us or our licensors
- You may not copy, reproduce, or distribute Platform content without written permission
9.2 User-Generated Content
- You retain ownership of content you upload (photos, reviews, listings)
- By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote your content
- You represent that you have the right to upload all content and that it does not violate any third-party rights
9.3 Copyright Infringement
- We respect intellectual property rights

- Description of the copyrighted work
- Location of the infringing content
- Your contact information
- A statement of good faith belief
- Your signature (electronic or physical)
10. Reviews and Ratings
- Reviews must be based on genuine experiences
- Reviews should be honest, fair, and constructive
- We reserve the right to remove reviews that violate our content policy
- Partners may respond to reviews but cannot demand removal of honest reviews
- Fake or manipulated reviews will result in account suspension
11. Liability and Disclaimers
11.1 Platform Role
- My Beautiful Ghana acts as an intermediary connecting Guests with Partners
- We do not own, operate, or control accommodations, tours, or products listed (unless explicitly stated)
- Partners are independent third parties responsible for their own services
11.2 Limitation of Liability
- We are not liable for:
- Quality, safety, or legality of listed services
- Accuracy of listings or Partner representations
- Actions or omissions of Partners or Guests
- Personal injury, property damage, or loss occurring during stays or tours
- Force majeure events (natural disasters, civil unrest, pandemics)
- Financial losses due to booking disputes
11.3 Maximum Liability
- Our total liability to you is limited to the amount you paid through the Platform for the specific transaction in question
- We are not liable for indirect, incidental, or consequential damages
11.4 Indemnification
- Your violation of these Terms
- Your violation of any rights of third parties
- Your use of the Platform

12. Dispute Resolution
12.1 Between Guests and Partners
- Disputes should first be resolved directly between the parties
- We may assist with communication but are not obligated to resolve disputes
- We do not make determinations on who is at fault
12.2 Chargebacks and Payment Disputes
- Payment disputes are handled by Paystack and relevant card networks
- We may investigate disputes and request additional documentation
- Frequent disputes may result in account suspension
12.3 Governing Law
- These Terms are governed by the laws of Ghana
- Disputes will be resolved in the courts of Ghana
- Mediation through alternative dispute resolution may be attempted before litigation
13. Privacy and Data Protection
- Your use of the Platform is also governed by our Privacy Policy
- We collect, use, and protect your data in accordance with Ghana’s Data Protection Act, 2012 (Act 843)
- Payment data is processed securely by Paystack in compliance with PCI DSS standards
14. Modifications to Terms
- We reserve the right to modify these Terms at any time
- Significant changes will be communicated via email or Platform notification
- Continued use of the Platform after changes constitutes acceptance
- If you disagree with changes, you must stop using the Platform
15. Account Suspension and Termination
15.1 By Us
- We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity
- Repeated cancellations or no-shows
- Failure to pay fees
- Abuse of other users or Partners
- Legal or regulatory requirements
15.2 By You
- You may close your account at any time
- Outstanding payments remain due upon account closure
- Certain data may be retained for legal compliance
16. Force Majeure
We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or technical failures.
